CASHME TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of CashMe, including the CashMe website, applications, Telegram and WhatsApp interfaces, exchange services, transfer services, customer support channels and any other products or services made available under the CashMe name (collectively, the “Services”).
By creating an account, accessing CashMe, requesting a quote, initiating or completing a transaction, or otherwise using the Services, you agree to these Terms.
If you do not agree to these Terms, you must not use the Services.
1. ABOUT CASHME
CashMe is a digital service platform designed to facilitate supported transactions involving virtual assets and fiat currencies and, where made available, transfers between users.
Depending on availability, jurisdiction and applicable law, CashMe may provide or facilitate:

purchase of supported virtual assets using fiat currency;
-
sale of supported virtual assets for fiat currency;
-
user-to-user transfers;
-
blockchain-based transfers;
-
payment through supported banks and mobile-money providers;
-
transaction processing through authorized CashMe tellers, agents, service personnel or partners;
-
transaction access through the CashMe website, Telegram, WhatsApp or other supported channels; and
-
additional wallet, payment, merchant, transfer, digital-asset or financial technology functionality introduced in the future.
Not every Service is available in every country.
CashMe may introduce, modify, restrict or discontinue Services in accordance with these Terms and applicable law.
2. REGULATORY STATUS
Nothing on CashMe shall be interpreted as representing that CashMe is a bank, central bank, deposit-taking institution, issuer of legal tender, investment adviser, broker, securities exchange or other regulated institution unless CashMe has expressly obtained and disclosed the relevant authorization.
Availability of a feature does not constitute a representation that the feature is lawful for every person in every jurisdiction.
CashMe may restrict or discontinue any Service, asset, transaction type or jurisdiction where reasonably necessary to comply with law, regulation, regulatory guidance, court orders or requirements of competent authorities.
3. ELIGIBILITY
You may use CashMe only if:

you are at least 18 years old or have otherwise reached the legal age required to enter binding financial transactions in your jurisdiction;
-
you have legal capacity to enter into these Terms;
-
you are not prohibited by applicable law from using the Services;
-
you provide accurate information when requested;
-
you are the lawful owner or authorized user of funds, accounts, wallets and payment methods used with CashMe; and
-
your use of CashMe does not violate applicable sanctions, anti-money-laundering, counter-terrorist-financing or other applicable laws.
CashMe may refuse registration or use of the Services where these requirements are not satisfied.
4. ACCOUNTS
Certain Services may require a CashMe account.
You must provide accurate, current and complete information and promptly update information that changes.
You are responsible for maintaining the confidentiality and security of your account credentials, devices, passwords, PINs and other authentication information.
You must promptly notify CashMe if you suspect unauthorized access to your account.
CashMe may impose additional authentication or verification requirements before processing sensitive transactions.
5. IDENTITY VERIFICATION AND KYC
CashMe may require identity verification before or during use of the Services.
Basic verification may include information such as:

legal name;
-
telephone number;
-
email address;
-
country;
-
date of birth;
-
government-issued identification; and
-
other information reasonably necessary to identify the customer.
CashMe may require additional or enhanced verification at any time where reasonably required because of transaction value, transaction frequency, risk indicators, applicable law, regulatory requirements, fraud concerns or compliance obligations.
Additional information may include source of funds, source of wealth, occupation or business information, transaction purpose, beneficiary information, proof of address, additional identification or supporting documentation.
Failure or refusal to provide requested information may result in a transaction being delayed, rejected, restricted or cancelled, or an account being suspended or terminated where legally permitted.
6. AML, CFT, SANCTIONS AND FINANCIAL CRIME
CashMe maintains the right to take reasonable measures intended to prevent money laundering, terrorist financing, proliferation financing, fraud, sanctions violations and other unlawful activity.
CashMe may monitor transactions and account activity and may conduct screening or investigations where reasonably necessary.
CashMe may delay, reject, restrict or suspend transactions or accounts where CashMe reasonably suspects unlawful activity or where required by applicable law.
CashMe may preserve and disclose information to competent authorities where disclosure is required or permitted by law.
Where applicable law prohibits CashMe from informing a customer about an investigation, report, request or restriction, CashMe may withhold such information.
7. PROHIBITED USE
You must not use CashMe:

for money laundering or terrorist financing;
-
to receive, conceal or transfer proceeds of crime;
-
to commit fraud, theft or deception;
-
to circumvent sanctions or legal restrictions;
-
for unauthorized third-party transactions;
-
using stolen bank, mobile-money, card or wallet credentials;
-
to impersonate another person;
-
to submit forged or manipulated proof of payment;
-
to abuse promotions, rewards or referral systems;
-
to interfere with CashMe’s systems or security;
-
to operate prohibited investment, gambling, scam or unlawful schemes;
-
to facilitate ransomware, extortion or other criminal activity; or
-
for any purpose prohibited by applicable law.
CashMe may investigate suspected violations and take appropriate action.
8. EXCHANGE SERVICES
Where CashMe provides a quote for the purchase or sale of a supported virtual asset, the quote may include:
-
exchange rate;
-
applicable fees;
-
fiat amount;
-
virtual-asset amount;
-
supported blockchain network; and
-
applicable limits or conditions.
Rates may change due to market conditions.
A displayed rate is not guaranteed until CashMe expressly confirms or locks the quote according to the transaction process.
If a customer fails to complete payment within the applicable quote period, CashMe may expire the quote and require a new quote.
9. FEES
CashMe may charge fees for Services.
Applicable fees should be disclosed before confirmation of a transaction where practicable.
Third parties—including banks, mobile-money providers, blockchain networks and wallet providers—may separately impose charges.
Unless expressly stated otherwise, CashMe is not responsible for independent third-party fees.
10. BANK AND MOBILE-MONEY PAYMENTS
CashMe may accept or make fiat payments using supported banks and mobile-money providers.
Customers must follow the payment instructions displayed or communicated for the relevant transaction.
A payment instruction issued for one transaction must not automatically be assumed to apply to another transaction.
CashMe may require confirmation that fiat funds have been finally received before releasing virtual assets.
Screenshots, SMS messages, receipts or other payment notifications do not by themselves constitute conclusive evidence that CashMe has received cleared funds.
CashMe may independently verify receipt.
11. THIRD-PARTY PAYMENT ACCOUNTS
CashMe may reject payments made from or to accounts belonging to persons other than the verified customer.
Where third-party payments are permitted, CashMe may request additional verification concerning the payer, beneficiary, relationship between parties and source or purpose of funds.
CashMe may return or hold funds where reasonably necessary to address fraud, ownership disputes, compliance concerns or legal requirements.
12. BLOCKCHAIN TRANSACTIONS
Blockchain transactions may be irreversible.
Before confirming a transaction, you are responsible for verifying:

wallet address;
-
blockchain network;
-
token or asset;
-
amount; and
-
other transaction information.
Sending virtual assets to an incorrect address, unsupported network, incompatible contract or incorrect destination may result in permanent loss.
CashMe does not guarantee that an incorrectly executed blockchain transaction can be recovered.
CashMe may attempt recovery where technically possible but may charge a reasonable recovery fee where disclosed and legally permissible.
13. NETWORK DELAYS
Virtual-asset transactions depend on blockchain networks outside CashMe’s direct control.
Transactions may be delayed because of network congestion, validator or miner activity, forks, protocol changes, outages, wallet-provider issues or other external events.
A transaction shall not necessarily be considered failed solely because confirmation takes longer than expected.
14. USER-TO-USER TRANSFERS
Where CashMe enables user-to-user transfers, the sender is responsible for selecting the correct recipient and confirming the transaction details.
Transfers may become final once executed.
CashMe may establish limits, verification requirements, cooling periods or additional security checks for transfers.
CashMe may delay a transfer where reasonably necessary to investigate suspected fraud, unauthorized activity, sanctions concerns or other compliance risks.
CashMe does not guarantee recovery of funds voluntarily transferred to the wrong person or to a person who subsequently proves fraudulent.
Nothing in this clause limits rights or remedies that cannot lawfully be excluded.
15. NO ESCROW UNLESS EXPRESSLY STATED
Unless CashMe expressly identifies a transaction as an escrow service, CashMe does not act as escrow between users.
A user-to-user transfer feature must not be interpreted as CashMe guaranteeing the underlying transaction, product, service or relationship between sender and recipient.
16. FRAUD AND SCAMS
Customers are responsible for exercising reasonable care before sending money or virtual assets.
CashMe will never guarantee profits from cryptocurrency investments or require customers to transfer funds to unlock fictitious winnings.
If you believe you have been targeted by fraud involving CashMe, you should contact CashMe immediately.
CashMe may attempt to prevent or investigate fraudulent transactions but cannot guarantee recovery once funds have been irreversibly transferred.
17. TELLERS, AGENTS AND SERVICE PERSONNEL
CashMe may use authorized tellers, agents, contractors or service personnel to assist with transactions.
Customers must use only tellers or payment instructions officially presented or confirmed through authorized CashMe channels.
A teller or agent has no authority to modify these Terms or promise guaranteed returns, investments or services not officially offered by CashMe.
CashMe may suspend or remove a teller or agent for security, operational, compliance or other legitimate reasons.
18. TELEGRAM, WHATSAPP AND OTHER CHANNELS
CashMe may permit customers to interact with the Services through third-party communication platforms.
Use of such channels is also subject to the terms and privacy practices of the applicable third-party platform.
Customers must verify that they are communicating with an official CashMe account or bot.
CashMe is not responsible for losses caused solely by a customer’s interaction with impersonators, fake accounts or unofficial channels where CashMe has taken reasonable steps to identify its official channels, except where liability cannot legally be excluded.
19. ERRORS AND INCORRECT CREDITS
If CashMe mistakenly credits an account, pays an incorrect amount or otherwise processes an erroneous transaction, CashMe may correct the error to the extent permitted by law.
A customer has no entitlement to retain funds or virtual assets that the customer knows or reasonably should know were credited by mistake.
CashMe may request repayment or reverse an internal ledger entry where technically and legally possible.
This does not authorize CashMe to reverse an irreversible blockchain transaction.
20. CHARGEBACKS AND PAYMENT REVERSALS
If a bank, mobile-money provider or other payment institution reverses or recalls a payment after CashMe has delivered virtual assets or other value, the customer remains responsible for any amount legitimately owed to CashMe, subject to applicable law.
CashMe may investigate the matter, restrict the relevant account and seek lawful recovery.
Fraudulent chargebacks may result in termination and reporting where legally appropriate.
21. TRANSACTION LIMITS
CashMe may establish minimum, maximum, daily, monthly, account-specific, country-specific or transaction-specific limits.
Limits may depend on verification status, risk profile, transaction history, liquidity, payment method, regulatory requirements or operational capacity.
CashMe may change limits where reasonably necessary.
22. TRANSACTION HOLDS AND REVIEWS
CashMe may place a transaction under review where reasonably necessary for security, fraud prevention, compliance, payment verification or dispute investigation.
A review does not imply wrongdoing.
CashMe will seek to process legitimate transactions within a reasonable period, subject to applicable legal restrictions.
23. REFUNDS AND CANCELLATIONS
The ability to cancel or refund a transaction depends on its processing stage.
A transaction generally cannot be cancelled after an irreversible blockchain transfer has been executed.
Where fiat funds have been received but the corresponding transaction cannot lawfully or operationally be completed, CashMe may return eligible funds to the original payment source, subject to verification, applicable fees, legal restrictions and third-party processing times.
CashMe may refuse to send a refund to an unrelated third-party account.
24. RECORDS AND EVIDENCE
CashMe may maintain transaction records, account records, system logs, communications, payment confirmations, blockchain transaction identifiers and compliance records.
Subject to applicable law, these records may be used to investigate transactions and resolve disputes.
Blockchain records may also provide independent evidence of virtual-asset transactions.
25. PRIVACY AND PERSONAL DATA
CashMe may collect and process personal information necessary to operate the Services, verify customers, prevent fraud, comply with law, provide customer support and maintain security.
Processing of personal data shall be subject to CashMe’s Privacy Policy and applicable data-protection law.
CashMe may share information with service providers, payment providers, professional advisers, fraud-prevention providers or competent authorities where there is a lawful basis to do so.
CashMe will not sell customer personal data merely because the customer uses the Services.
26. SECURITY
CashMe may implement security controls including authentication, device monitoring, transaction limits, account verification and fraud-detection mechanisms.
No electronic system or blockchain network is completely risk-free.
Customers must take reasonable measures to secure their devices, accounts, wallets and credentials.
27. TAXES
Customers are responsible for determining and satisfying their own tax obligations arising from use of CashMe unless applicable law requires CashMe to collect, deduct, report or remit a tax.
CashMe does not provide individual tax advice.
28. NO INVESTMENT ADVICE
CashMe facilitates transactions and does not, merely by offering an exchange or transfer service, provide investment, financial, legal or tax advice.
Availability of an asset through CashMe is not an endorsement or recommendation to purchase, hold or sell that asset.
Customers are responsible for their own financial decisions.
29. DIGITAL-ASSET RISKS
Virtual assets involve significant risks.
These may include price volatility, loss of value, technological failure, protocol changes, cyber incidents, liquidity risk, regulatory changes and loss caused by user error.
Customers should transact only after understanding these risks.
30. SERVICE AVAILABILITY
CashMe aims to maintain reliable Services but does not guarantee uninterrupted availability.
Maintenance, technical problems, cyber incidents, third-party outages, blockchain disruption, telecommunications failure or events outside reasonable control may temporarily affect Services.
CashMe may temporarily suspend Services where reasonably necessary for maintenance, security, compliance or system integrity.
31. SUSPENSION AND TERMINATION
CashMe may restrict, suspend or terminate an account or Service where reasonably necessary because of:
-
violation of these Terms;
-
suspected fraud or unlawful activity;
-
security concerns;
-
false or misleading information;
-
sanctions or AML/CFT concerns;
-
regulatory or legal requirements;
-
abusive conduct;
-
material risk to CashMe or other users; or
-
discontinuation of a Service.
Where legally and operationally possible, CashMe will seek to allow legitimate customer property to be withdrawn or returned following required verification and resolution of outstanding obligations.
32. REGULATORY AND LAW-ENFORCEMENT REQUESTS
CashMe may respond to valid requests, orders, warrants, court processes or other lawful demands issued by competent authorities.
CashMe may preserve, disclose, restrict or otherwise handle information or transactions where required by applicable law.
CashMe is not required to notify a customer where notification is prohibited by law.
33. GEOGRAPHIC RESTRICTIONS
CashMe may determine where particular Services are available.
A customer must not circumvent geographic restrictions through VPNs, false residency information, proxy accounts or other deceptive methods.
CashMe may restrict Services in any jurisdiction where continued operation creates material legal, regulatory, sanctions or operational risk.
34. THIRD-PARTY SERVICES
CashMe may depend on banks, mobile-money operators, blockchain networks, telecommunications providers, hosting companies, messaging platforms and other third parties.
Those services are not entirely controlled by CashMe.
CashMe is not responsible for a third party’s independent acts or failures except to the extent responsibility cannot lawfully be excluded or the loss was caused by CashMe’s own legally actionable conduct.
35. INTELLECTUAL PROPERTY
The CashMe name, branding, software, website design, documentation and other proprietary materials are owned by or licensed to CashMe unless otherwise stated.
No right to use CashMe’s intellectual property is granted except as necessary for ordinary use of the Services.
36. CUSTOMER COMMUNICATIONS
CashMe may communicate with customers electronically, including through the website, email, SMS, Telegram, WhatsApp, in-app messages or other contact details provided by the customer.
Customers are responsible for maintaining accurate contact information.
Important legal or security notices may be delivered electronically where permitted by law.
37. CUSTOMER SUPPORT AND COMPLAINTS
Customers should first submit transaction questions and complaints through CashMe’s official support channels.
CashMe will maintain a reasonable process for reviewing complaints and may request transaction identifiers, payment evidence, identity verification or other information necessary to investigate.
Nothing in these Terms prevents a customer from exercising any right to complain to a competent regulator, authority or court where such right exists under applicable law.
38. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, CashMe shall not be liable for indirect, incidental, special, punitive or consequential losses arising solely from matters outside CashMe’s reasonable control.
This may include losses caused by blockchain congestion, customer error, incorrect wallet information, independent third-party outages or unauthorized conduct that CashMe could not reasonably have prevented.
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability arising from fraud, wilful misconduct or other liability that applicable law requires CashMe to bear.
39. INDEMNITY
To the extent permitted by law, you agree to indemnify CashMe against reasonable losses, liabilities, claims and expenses arising directly from your unlawful use of the Services, material breach of these Terms, fraud or infringement of another person’s rights.
This provision does not require a consumer to indemnify CashMe for CashMe’s own unlawful conduct, negligence where liability cannot be excluded, or breach of obligations imposed on CashMe by law.
40. FORCE MAJEURE
CashMe shall not be responsible for delay or failure caused by events beyond its reasonable control, including natural disasters, war, civil disturbance, government action, internet or telecommunications failures, widespread cyber incidents, blockchain failures, banking interruptions or similar extraordinary events.
CashMe must nevertheless take reasonable steps required by applicable law to mitigate the effects of such events.
41. CHANGES IN LAW OR REGULATION
Digital-asset regulation evolves rapidly.
If a change in law, regulation, regulatory interpretation, court decision or governmental requirement affects a Service, CashMe may modify, restrict, suspend or discontinue the affected Service.
CashMe may require additional verification or impose new transaction conditions where reasonably necessary for compliance.
42. FUTURE PRODUCTS
CashMe may introduce additional services including wallet functionality, custodial or non-custodial services, additional virtual assets, merchant payments, cross-border functionality, rewards or other financial-technology products.
A future product may be governed by additional product-specific terms.
Where additional terms conflict with these Terms, the product-specific terms will govern that product to the extent of the conflict.
The launch of a feature is subject to any licensing, registration, approval or other legal requirement applicable at the time.
43. TRANSFER OF THE CASHME BUSINESS
CashMe may in the future be incorporated, reorganized, transferred to a registered company, merged with another business or operated through another lawful legal structure.
Subject to applicable law, CashMe may assign or transfer these Terms and related customer relationships to a successor or affiliated operator that assumes the relevant obligations.
Where legally required, customers will be notified and consent will be obtained.
44. CHANGES TO THESE TERMS
CashMe may update these Terms to reflect changes in Services, technology, security, law or business operations.
Material changes will be communicated by reasonable means where required.
Continued use after an updated version becomes effective constitutes acceptance only to the extent permitted by applicable law.
Where affirmative consent is legally required, CashMe will request it.
45. SEVERABILITY
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.
The invalid provision shall be interpreted or modified only to the minimum extent necessary to make it lawful and enforceable.
46. NO WAIVER
Failure by CashMe to immediately enforce a provision of these Terms does not automatically waive CashMe’s right to enforce it later.
47. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, applicable transaction terms, Risk Disclosure and any product-specific terms presented to the customer, constitute the agreement governing use of the relevant CashMe Services.
48. GOVERNING LAW AND DISPUTES
Unless mandatory law applicable to a customer requires otherwise, these Terms and the relationship between CashMe and the customer shall be governed by the applicable laws of the United Republic of Tanzania.
Customers and CashMe should first attempt in good faith to resolve disputes through CashMe’s internal complaints process.
Nothing in these Terms removes any mandatory right of a customer to approach a competent regulator, authority or court.
The appropriate court, tribunal or dispute-resolution forum shall be determined according to applicable law and jurisdiction.
49. COUNTRY-SPECIFIC TERMS
Customers outside Tanzania may be subject to additional country-specific terms.
If mandatory local law provides rights or obligations that conflict with these Terms, the mandatory local law applies to the extent required.
CashMe may require acceptance of additional jurisdiction-specific terms before providing Services in a particular country.
50. CONTACT
Questions, complaints, security reports and legal notices concerning CashMe should be submitted through the official contact details published on the CashMe website.
Customers should not rely on contact details supplied by unofficial social-media accounts, private messages or third parties.
IMPORTANT DIGITAL-ASSET NOTICE
Virtual assets are not risk-free.
Blockchain transactions may be irreversible, virtual-asset values may fluctuate, and regulatory treatment may change.
CashMe does not guarantee profits, investment returns or appreciation in the value of any virtual asset.
Always verify transaction details before authorizing a transfer.
By creating a CashMe account or using a CashMe Service, you acknowledge that you have read, understood and agreed to these Terms of Service.
